The state has no authority to require utilities to pay the costs of installing solar panels on their properties. A group of landowners suing the utility filed suit Monday asking a federal judge to block the utility from continuing that practice.

The suit, filed by landowner Mike McBride of Lake County, said the state, through the Public Service Commission (PSC), has failed to provide the proper information needed to provide proper oversight for its use of the state's renewable energy program.

If the PSC issues a rule that requires utility companies to install solar on their properties and pay a fixed costs associated with it, it would put the onus on developers to meet those costs, McBride said.

"At a time when more states are pursuing solar as a way to increase local economy, the state has simply ignored the process in question, instead opting to provide benefits to those in the most benefit," the suit says.

"If the state does not take a stand against solar and does not allow for more competitive and efficient solar development, then it has violated the rights of our residents and investors to ensure that the economy gains from these natural resources," the suit says.

The utility has denied the allegations. The PSC issued a statement Monday: "We are in no rush to resolve this and cannot comment further at this time. We continue to evaluate the allegations. We recognize that our utility partners need to learn about their solar programs, however we believe our partners have been well aware of our utility program and are well positioned for future growth."

McBride, a retired truck driver who has built his family's barn on land that was leased to his customers for more than 40 years, is not the only one trying to hold the utility accountable.

He and other landowners are challenging the state's policies for homeowners, too.

The solar policy

While the utility's solar program is a federal program that provides rebates, the cost of solar panels used in the state is largely the responsibility of utilities. The PSC regulates and oversees residential solar projects but does not charge utilities to install solar panels. That means utilities must follow the rules of the PSC and give them a guarantee they won't be charged by the PSC to cover other costs, such as maintaining and rebuilding roofs over their property.

Solar panels sold to residents are supposed to come from the utility's electricity grid, a process that can take three to seven days. The utility must spend five percent of a property's energy consumption on the installation and also provide a refund for the electricity.
